Gov. Tim Pawlenty recently signed an executive order banning Minnesota cities and businesses from applying for federal grants made available since the health care law went into effect. As a result, the state could miss out on billions of dollars in federal funds.
5.3 Amendment. No amendment of any provision of this Agreement will be effective unless made in writing and signed by an officer or duly authorized representative of each party; provided that the Investor may unilaterally amend any provision of this agreement to the extent required to comply with any changes after the Signing Date in applicable federal statutes. No failure or delay by any party in exercising any right, power or privilege hereunder shall operate as a waiver thereof nor shall any single or partial exercise thereof preclude any other or further exercise of any right, power, or privilege. The rights and remedies provided herein shall be cumulative of any rights or remedies provided by law.
